Insurance Coverage Disputes
Al Haverkamp represents policyholders in insurance coverage disputes and bad faith lawsuits. An area of particular focus is representing public entities in disputes with their Excess Workers’ Comp insurers. Al has a proven track record of significant recoveries from insurers and has recovered over $35 million for institutional clients. Since 2015, Al has acted as insurance coverage counsel for the San Diego County Schools Joint Powers Authority, which includes over 65 school districts. Since 2013, Al has authored “Coverage Quiz” for the San Diego Risk and Insurance Management Society’s publication. Al has presented on coverage issues for the National Council of Self-Insurers, PARMA, RIMS, the California Self-Insurer’s Association, the Independent Cities Risk Management Authority, Adminsure, Athens, Tri-Star, and Sedgwick.
Significant Insurance Coverage Recoveries:• $22.4 million recovery for the Fresno Unified School District in insurance bad faith case against G.E. Capital insurer. The case included a month-long jury trial, a jury award of $13 million in punitive damages, a five-year appeal, and an affirmance of the Verdict by the Court of Appeal. The case involved a failure to defend and indemnify the District under a CGL policy.• Recovered $3.3 million for the City of Manhattan Beach in a bad faith case against the City’s Excess Workers’ Compensation Insurer. The case was litigated in the US District Court. The underlying workers’ compensation claim was complex and spanned over 30 years.• Recovered $2.7 million for the San Diego Unified School District in a bad faith case against the District’s Excess Workers’ Compensation Insurer. The case was litigated in the US District Court and involved multiple underlying workers’ compensation claims which exceeded the policy’s retention.• Recovered $1.3 million for the City of Escondido in a bad faith case against the City’s Excess Workers’ Compensation Reimbursement Insurer. The case was litigated in US District Court and involved three underlying workers’ comp claims on which the insurer refused to reimburse over multiple years. • Recovered $1.5 million for Welk Resorts in a bad faith case in US District Court. The case involved underpayment by the Resort’s insurer for a business interruption loss.• Recovered over $2 million for the San Diego County Schools Joint Powers Authority and California Self-Insurer’s Security Fund on multiple claims against the JPA’s and Fund’s respective Excess Workers’ Compensation Insurers.• Recovered $170,000 for contractor in dispute with Highrise Project’s owner and the Project’s OCIP carrier. Won summary adjudication against owner for failing to procure the required OCIP coverage and won summary adjudication against OCIP carrier with Court finding the lawsuit constituted a single occurrence.
